Terms of Service

Version 2026-10-21. Effective October 21, 2026.

These Terms are an agreement between you and Popcoach. Please read them. They cover the Popcoach website (popcoach.io), the Popcoach iPhone app and the Popcoach Android app. In these Terms, "Popcoach" means all three.

Short version: coaches list what they offer, clients book and pay through Popcoach, and we pay coaches. Be decent to each other. Refunds are always the full amount or nothing.

1. Who we are

Popcoach is run by POPCOACH LLC, a Florida limited liability company. Our mailing address is 1701 N Florida Ave Unit 509, Tampa, FL 33602-2271. "We", "us" and "our" mean Popcoach. "You" means the person using Popcoach.

Popcoach is a marketplace. Coaches are independent businesses, not our employees. When you book a coach, the coach provides the session, event, experience or content. We run the platform, take payment and pay the coach. Studio classes work differently: see section 7.

2. Your account

  • You need an account to book, buy, message or post.
  • You must be at least 18 to have an account. If a child is coming to a session or popup, a parent or guardian must book it and is responsible for them.
  • Use your real name and accurate details. Keep your sign-in secure. You're responsible for what happens under your account.
  • One person per account. Don't use someone else's account or let them use yours.
  • You can sign in with Apple, Google or email.

3. Using Popcoach as a client

Booking and paying

  • You pay through Popcoach by card, Apple Pay or Google Pay. Square processes the payment. We never see your full card number.
  • When you buy from a coach, you pay Popcoach. We collect the payment for the coach and pay them later.
  • Sessions, experiences and partner-gym sessions are paid in full when you book.
  • For a custom experience, you send a request and the coach sends a quote. You're charged only when you accept the quote. A quote can include travel costs, which you see before you pay.

Prices and fees

  • Listings show the coach's price. Fees are added at checkout.
  • Checkout shows every charge before you pay:
    • Platform fee. Our fee. It depends on the coach's plan. If the coach is on a Pro or Studio plan, you pay a 2% platform fee and the coach pays none. Otherwise, the coach decides whether you pay it, they pay it, or you split it. If the coach pays it all, you won't see this line.
    • Card processing fee. Covers the cost of taking your card payment. You pay this on every purchase.
  • The total at checkout is what you pay. Popcoach doesn't collect sales tax.
  • At a partner gym, the price includes a fee for the space, which goes to the gym.

Promo codes. Coaches can offer promo codes on popup tickets. Codes don't work on sessions, experiences or content.

Popup waivers. Some popups ask you to sign a liability waiver after you buy a ticket. The waiver is a separate agreement, and you can read it before you sign. We keep signed waivers, even if you delete your account.

Community groups. If a popup is linked to a coach's community group, buying a ticket adds you to that group. You can leave any time.

4. Cancellations and refunds

The main rule: a refund is always the full amount you paid, or nothing. There are no partial refunds. A full refund includes the platform fee and card processing fee you paid. Refunds go back to the card or wallet you paid with. How long it takes to show up depends on your bank.

The policy you saw when you bought is the one that applies. We save the cancellation policy on your purchase at the moment you pay. If the coach changes their policy later, your purchase keeps the old one.

Sessions (including sessions at partner gyms)

  • Cancel more than 24 hours before the start: full refund.
  • Cancel within 24 hours, or don't show up: no refund, and the coach is paid.
  • You can move a session for free until 24 hours before it starts. The 24 hours then counts from the new time.
  • If the coach cancels: full refund.

Experiences (private groups, company events, brand work)

  • Each experience has a cutoff of 7, 30 or 60 days before it starts, shown before you pay.
  • Cancel before the cutoff: full refund.
  • You also get a full refund if you cancel within 24 hours of paying, even if you're already past the cutoff.
  • After that: no refund, and the coach is paid.
  • If the coach cancels: full refund.

Popup tickets

  • Each popup shows its cancellation policy at checkout. Each one is one of these:
    • Flexible: full refund up to 24 hours before.
    • Moderate: full refund up to 7 days before.
    • Strict: full refund up to 48 hours before.
    • Final sale: no refunds.
  • To cancel a ticket, message the coach. The coach must honor the policy you saw at checkout. If the coach doesn't reply within 48 hours, contact us and we'll refund you under that policy.
  • If the coach cancels the popup, everyone gets a full refund. That includes "final sale" tickets.
  • A coach can also choose to give you a full refund at any time.

Courses, products and libraries (online content)

  • Each item shows its refund policy before you buy. The window counts from the day you bought it:
    • Full refund within 14 days, or
    • within 7 days, or
    • within 2 days, or
    • "All sales are final. No refunds."
  • Products and libraries: you can get a refund only if you haven't opened or downloaded any of the files.
  • Courses: you can get a refund within the window no matter how far you've got.
  • Ask for a refund with the "Request refund" button on the content page.
  • When a refund goes through, your access ends straight away, and any certificate from that course is cancelled.
  • Content you unlocked with a free access code has nothing to refund.

Studio classes. See section 7. Popcoach doesn't take payment for studio classes, so anything you paid a studio is covered by the studio's own refund rules.

Disputing a charge with your bank. Please contact us first at general@popcoach.io. We can usually sort it out faster.

5. Coaches: the basics

These sections apply if you list anything on Popcoach.

You're independent. You run your own business. You're not our employee, agent or partner. You decide what to offer, when, where and at what price, within these Terms. You're responsible for your own business costs, permits and insurance.

You're responsible for what you offer.

  • Your profile, photos, prices, times, locations and descriptions are accurate when you publish.
  • Only teach what you're trained and qualified to teach.
  • Any certification you list is real, yours and current.
  • You keep clients safe at your sessions and events: the space, the equipment, the plan for an emergency. Ask clients about injuries and health conditions before you train them.
  • You follow the laws that apply to you, including any licenses your city or state requires.
  • Insurance: we strongly recommend liability insurance. A partner gym may require it.

Verification. You can upload certifications, CPR/AED cards and proof of insurance. Our team reviews each one. You get a Verified badge if at least one approved document is current. The badge means we checked the document you gave us. It doesn't mean we've done a background check, watched you coach, or guarantee your work. You can publish without the badge.

Keep bookings on Popcoach. Don't ask clients to pay you outside Popcoach for anything they found or booked on Popcoach.

Cancelling. If you have to cancel, cancel in Popcoach so every client is told and refunded in full. When you cancel a popup, you write a short message that goes to everyone with a ticket. Don't just not show up.

Refunding a client. You can give a full refund (never a partial one) for a popup ticket, a past session or experience, or a content sale, as long as the sale hasn't been paid out to you yet. You need to give a reason, and the client gets an email. Once a sale has been paid out, contact us and we'll handle it. You aren't paid for a refunded sale.

Brand work and company bookings. For brand work, you describe in your quote what you'll deliver and how the brand may use the content. That part is an agreement between you and the brand. Popcoach takes payment and pays you, but isn't a party to the creative or usage terms.

Partner gyms. To train at a partner gym, you accept that gym's space agreement in Popcoach. It's a separate agreement, and it's updated when the gym's rules change.

6. Coaches: plans, fees, payouts and taxes

Platform fee

  • We charge a platform fee on each sale of popup tickets, sessions and experiences. The rate depends on your coach plan (see "Coach plans" below).
  • Starter (free): a 20% platform fee. You choose who pays it:
    • the client pays it on top,
    • you split it 50/50 with the client, or
    • you absorb it from your payout.
  • You can set this for your account, and change it for individual popups. A change applies to new sales only.
  • Pro and Studio: you pay no platform fee. Your clients pay a 2% platform fee on top of your price at checkout. This applies to all your sales while you're on Pro or Studio, whatever you chose before.
  • The rate is fixed on each sale at the moment it's made. It's saved with the sale and shown in your Earnings, and it never changes afterwards. If you change plans, the new rate applies from your next sale. Sales made before July 27, 2026 were charged 15%.
  • There's no platform fee on online content sales right now, or on travel costs in a quote. If that changes, we'll tell you first, and only new sales will be affected.
  • If you mark a popup as a charity event, or we waive the fee for a popup, the fee is 0% on sales from then on. Earlier sales keep the fee they were charged.
  • Card processing fees are always paid by the client on top of the price. They never come out of your payout. When you refund a sale, Popcoach covers the card fee that the card processor keeps. You aren't charged for it.
  • If we change the platform fee, we'll tell you before it applies. It applies to new sales only.

Coach plans

Every coach is on one of three plans. Starter is free. Pro and Studio are paid monthly subscriptions.

  • Starter: free. The 20% platform fee above. Up to 3 session types and 1 community group.
  • Pro: $39 a month. No platform fee from you (clients pay 2%). Unlimited session types and community groups, plus courses and experiences.
  • Studio: $99 a month. Everything in Pro, plus Studio class booking (section 7).

Founding coach price. If you had a coach profile on Popcoach before November 2, 2026, or you start Pro or Studio by 11:59 pm Eastern time on December 31, 2026, you pay $29 a month for Pro or $79 a month for Studio. The founding price stays with your account for life. It carries over if you change between Pro and Studio, and you get it again if your plan ends and you start one later.

Free period. Coaches who start with the founding price get their first month free. After the founding offer ends, new plans come with a 30-day free trial. Each coach gets one free period, ever. When it ends, your plan carries on at the monthly price unless you cancel before then.

Paying for a plan

  • On the website, you pay by card. Square processes the payment, and the plan is billed monthly to the card you saved.
  • In the iPhone or Android app, you pay through Apple's App Store or Google Play. Apple or Google takes the payment, and their terms apply to billing, cancelling and refunds for that plan. You manage it in your Apple account's Subscriptions or in Google Play.
  • You can have one plan at a time. A plan is managed where you bought it.
  • Prices are in US dollars. They're the same on the website, iPhone and Android.

Renewal. Your plan renews automatically every month until you cancel. We, Apple or Google charge the monthly price on each renewal date.

Cancelling. You can cancel any time. On the website, choose Downgrade to Starter in Your plan. In the apps, cancel in your Apple or Google Play subscriptions. You keep your plan until the end of the month you've paid for, then you move to Starter. On the website, you can undo a scheduled change with Cancel change before it takes effect.

Changing plans. On the website, moving up (Pro to Studio) starts straight away, and the new price starts from your next billing date. Moving down (Studio to Pro, or to Starter) takes effect at the end of the month you've paid for. We confirm every change on screen. In the apps, Apple or Google decide when a change takes effect and how it's billed.

Refunds. Plan payments aren't refunded for part of a month, including when you cancel or move down partway through. If you think you were charged by mistake, contact us. For a plan bought through Apple or Google, refunds are handled by them.

If a payment fails. A failed payment doesn't end your plan straight away. You keep your plan and its fee rate while the payment is tried again, and the amount is still owed. Please update your card in Your plan. Apple and Google try again for a period they set, and if they end the subscription, your plan ends and you move to Starter.

When a plan ends or moves down. Nothing you made is deleted. From then on:

  • new sales use the fee of your new plan (on Starter, the 20% platform fee),
  • on Starter you can't add more than 3 session types or more than 1 community group. The ones you have keep working,
  • on Starter you can't create new courses or new experiences. The ones you have keep selling,
  • Studio class booking is part of the Studio plan. Classes clients have already booked are kept.

Deleting your account with a plan. Deleting your account cancels a plan you bought on the website. A plan bought through Apple or Google has to be cancelled there first, because we can't stop their charges.

Payouts

  • We pay you by QuickBooks direct deposit. We send you a link to add your bank details. We don't pay by Zelle.
  • A sale becomes ready to pay:
    • for popups, sessions and experiences: 3 days after the date it took place, and
    • for content: the day after its refund window ends, and never sooner than 3 days after the sale.
  • If a popup moves, the 3 days count from the new date.
  • We pay each listing all at once, when its last sale is ready.
  • Your first direct deposit takes about 3 business days after your bank details are verified. After that, payments usually arrive the next business day. We don't promise a fixed weekly schedule.
  • A refunded sale pays you nothing.
  • We may hold a payout while we look into a problem, such as a figure we can't confirm, a report about the listing, or suspected fraud. We'll tell you why.
  • Chargebacks: if a client wins a chargeback because of fraud, or because you didn't deliver what was booked, we may take that amount out of your future payouts. We never do this for an ordinary refund.

Taxes. You're responsible for your own taxes on what you earn. Popcoach doesn't collect sales tax, and doesn't send tax forms yet. Your Earnings page lists your sales and payouts for your records.

7. Studio classes

A coach or studio on the Studio plan can run class booking on Popcoach: a class schedule, drop-ins, class packs, memberships, waitlists and check-in.

Paying the studio. Popcoach doesn't take payment for studio classes, packs or memberships. If you pay a studio, you pay it directly, outside Popcoach, under the studio's own terms and refund rules. Popcoach isn't part of that payment.

Credits. The studio adds class credits, packs or memberships to your account in Popcoach. You use a credit to book a class. If credits have an expiry date, it's shown in the app.

Booking and cancelling. Each studio sets how far ahead you can book, its cancellation cutoff, and whether a late cancel or a no-show uses up your credit. These rules are shown when you book and saved with your booking.

Waitlists. If a class is full, you can join its waitlist. If a spot opens, we book you automatically with one of your credits and let you know. If you have no credit left, the spot goes to the next person. Close to the start of class, the studio's own cutoff applies and no one is moved up automatically.

If the studio cancels a class, your credit comes back.

A studio is responsible for its classes in the same way a coach is (sections 5 and 14).

8. Content you post, and content you buy

What you post stays yours. That includes your profile, photos, posts, comments, messages, reviews, courses and files. You give us permission to host it, show it, copy it as needed to run Popcoach, deliver it to people who buy it, and use your public listings and profile to promote Popcoach. This permission is worldwide and free. It ends when you delete the content or your account. It doesn't end for copies already delivered to buyers, records we have to keep, or backups that clear out over time.

Only post what you have the right to post. Before you upload a document to build a course, you confirm you own it or have permission to use it.

How course import works. When you import a document, Popcoach uses secure cloud services and AI to read it and draft your course. Nothing is published until you review and approve it. Your original file stays private to your account.

Content you buy. When you buy a course, product or library, you get a personal license to use it for yourself.

  • Access doesn't expire, unless you get a refund or delete your account.
  • If the coach archives the item later, you keep access.
  • Where the content has a download button, you can download files for your own use.
  • Don't share, resell, post or copy it for anyone else, and don't share your account to give someone else access.

Access codes. A coach can give you a free code that unlocks a course. It works like a free purchase.

Content in the apps. Courses and other online content can't be bought in the iPhone or Android app. You can use what you've bought in the apps.

Reviews. Only review a session, popup or experience you actually attended. We check reviews before they appear, and we may decline or remove one that breaks these Terms. Coaches can't remove reviews of themselves.

Our name and app. The Popcoach name, logo, design and software belong to us. You can't copy them or use them to suggest we endorse you.

9. Community rules

We have zero tolerance for abusive or objectionable content and behavior. These rules apply everywhere on Popcoach: messages, community groups, posts, comments, course comments, reviews, profiles, and in person at sessions, classes and events.

Not allowed:

  • Harassment, threats, bullying, or hate based on who someone is. That includes body shaming.
  • Sexual content, or romantic or sexual messages from a coach to a client.
  • Violence, or encouraging self-harm.
  • Anything illegal or dangerous.
  • Spam, scams, unwanted ads and sales pitches.
  • Fake accounts, fake reviews, or pretending to be someone else.
  • Sharing someone's personal details, messages or photos without their OK.
  • Recording people at a class without asking.

Who can message whom. Clients can message coaches. A coach can only start a chat with someone who has a connection to them, such as a booking, a ticket, a request, a purchase or community group membership. Only a community group's owners can post in it. Members can comment. Owners can remove posts and comments in their groups.

Report. You can report a message, chat, post, comment, course comment, review or profile. Choose Report from its menu, pick a reason and add a note if you like. Coaches can also report a client from their client list. You can email general@popcoach.io too. If someone is in danger, call 911 first. We don't tell the person you reported that you reported them.

Block. You can block someone from their messages, posts, comments, reviews or profile. After you block someone:

  • neither of you can message the other, in any chat, and neither of you can start a new chat,
  • your chat with them leaves your inbox,
  • you stop seeing each other's posts and comments in community groups,
  • they aren't told that you blocked them.

If a coach blocks you, you're also removed from the community groups they run, and you can't join them again. Blocking doesn't cancel bookings, tickets or payments you already have. You can see and unblock the people you've blocked in Privacy and data, under Blocked people.

What we do. Our team reviews every report within 24 hours. If something breaks these rules, we remove it. We may also suspend or close the account of the person who posted it. A suspended person can't send messages, post, comment or review. A suspension doesn't cancel bookings or tickets, or touch money that's owed. We decide what action to take based on what happened. We let you know when we've reviewed your report, but we don't always say what we did.

Filtering. We block posts, comments, course comments and reviews that contain certain offensive words. Private messages aren't filtered, but you can report them.

10. Payments and our payment partners

Square processes card payments, including Apple Pay and Google Pay. Coach plans bought in the apps are processed by Apple or Google. When you pay, you also agree to the terms of the payment method you use. Coach payouts are made by QuickBooks direct deposit. We don't store full card numbers.

11. Privacy

Our Privacy Policy explains what we collect and how we use it. Some highlights:

  • Coaches see your contact details only in their client list. Everywhere else, people see names.
  • Coaches appear to others as their first name and last initial.
  • Marketing emails are off unless you turn them on.
  • You can turn push notifications off in your phone's settings.

12. Apple and Google

If you got Popcoach from Apple's App Store

  1. These Terms are between you and Popcoach, not Apple. Popcoach, not Apple, is responsible for the app and its content.
  2. You can use the app on Apple devices you own or control, as Apple's App Store Usage Rules allow.
  3. Apple has no duty to provide maintenance or support for the app.
  4. If the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund what you paid for the app, if anything. The app is free. Apple has no other warranty duty for the app, as far as the law allows. Any other claims, losses, costs or expenses from a warranty failure are Popcoach's responsibility, not Apple's.
  5. Popcoach, not Apple, is responsible for any claims about the app, including product liability claims, claims that the app breaks a law or regulation, and consumer protection or privacy claims.
  6. If someone claims the app or your use of it infringes their intellectual property, Popcoach, not Apple, is responsible for investigating, defending, settling and resolving it.
  7. You confirm you're not in a country under a US government embargo or named as a "terrorist supporting" country, and you're not on any US government list of prohibited or restricted parties.
  8. Questions, complaints or claims about the app go to Popcoach: POPCOACH LLC, 1701 N Florida Ave Unit 509, Tampa, FL 33602-2271, general@popcoach.io.
  9. You must follow any third-party terms that apply when you use the app, such as your mobile carrier's.
  10. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple can enforce them against you.

If you got Popcoach from Google Play: these Terms are between you and Popcoach, not Google. Google Play's own terms cover downloading the app, and any coach plan you buy through Google Play.

13. Ending your account

You can delete your account at any time. Use "Delete my account" in Privacy and data, on the website or in the iPhone or Android app, or email general@popcoach.io.

When you delete your account:

  • We delete or anonymize your personal details, profile, preferences and the messages you sent.
  • You lose access to content you bought and to any upcoming tickets or bookings. Cancel anything you want refunded first, under its policy.
  • We keep some records where the law or our legitimate business needs require it:
    • purchase, refund and payout records, with your name replaced by an anonymous ID, and
    • signed liability waivers, kept in full.
  • Deletion is usually immediate. Sometimes it takes up to 7 days to finish.

If you have an active studio membership, cancel it first. The delete screen shows you how.

Coaches: you can't delete your account while you have an upcoming popup with tickets sold, upcoming bookings, or payouts we haven't sent yet. The same goes for a studio with upcoming booked classes or active members. Cancel or finish those first, or contact us. A coach plan bought through Apple or Google has to be cancelled there first (section 6).

We can suspend or close an account that breaks these Terms, puts people at risk, or is used for fraud. Where it's safe to do so, we'll tell you why. A suspension doesn't cancel bookings or touch money that's owed. Coaches are still paid for sales they delivered, unless the sale is refunded.

14. Fitness risk, disclaimers and limits

Exercise has risks. Training can cause injury. Check with a doctor before you start, especially if you have a health condition, an injury or you're pregnant. Stop if something hurts. Nothing on Popcoach is medical advice.

We don't control coaches. Coaches and studios are independent. We don't supervise their sessions or classes, and we don't guarantee their qualifications, results or conduct, beyond reviewing the documents described in section 5. The coach is responsible for what happens at their sessions and events.

Popcoach is provided "as is". We work hard to keep it running, but we can't promise it'll always be available, error-free or secure. As far as the law allows, we don't give warranties beyond what these Terms say.

Limits on what we owe. As far as the law allows:

  • We're not responsible for indirect or consequential losses, such as lost profits or lost data.
  • Our total responsibility to you for any claim is limited to the fees you paid Popcoach in the 12 months before the claim, or $100, whichever is more.
  • Nothing in these Terms limits responsibility that can't be limited by law, such as for fraud, or for death or injury caused by our negligence where the law doesn't allow that to be excluded.

Your responsibility to us. If you break these Terms or the law, and someone makes a claim against us because of it, you'll cover our reasonable costs. For coaches, that includes claims about your sessions, classes, events and content.

15. Disagreements

Talk to us first. Email general@popcoach.io. Most problems can be fixed quickly.

Governing law. These Terms are governed by the laws of the State of Florida.

Arbitration. If we can't sort out a disagreement, it goes to binding arbitration with the American Arbitration Association, in Florida, on an individual basis. That means no class actions and no jury trials. Either of us can take a claim to small claims court instead. You can opt out of arbitration by emailing general@popcoach.io within 30 days of first agreeing to these Terms.

Courts. Anything that doesn't go to arbitration or small claims goes to the state and federal courts in Hillsborough County, Florida.

16. Changes to these Terms

  • We may update these Terms. When we do, we'll change the version at the top.
  • For a big change, we'll tell you in the app or by email before it takes effect, and ask you to agree to the new version.
  • We record which version you agreed to, and when.
  • If you don't agree to a new version, you can stop using Popcoach and delete your account.
  • Purchases you've already made keep the cancellation policy and fee rate stamped on them, whatever we change later.

17. Other things

  • If part of these Terms can't be enforced, the rest still applies.
  • If we don't enforce a rule straight away, we can still enforce it later.
  • You can't transfer your account or these Terms to someone else. We can transfer them if Popcoach is sold or reorganized.
  • These Terms, the Privacy Policy, any waiver you sign and any partner-gym agreement you accept are the whole agreement between you and us about Popcoach.
